Where's the WestLaw Junkies?

Does anyone know whether WestLaw has a feature that allows you to determine if a case has been legislatively overruled?

I recently came across a case that I was very stoked to find. Upon KeyCite, things looked great. Upon reading some practice guides, I realized the case had been legistatively overruled. Thing is, there was no mention of this on KeyCite or Direct History.

Any ideas?

  • KeyCite only reference cases. However, there might be cases that reference statute overturning case. For example, Employment Div. v. Smith, 494 U.S. 872 was overturned by the Religious Freedom Restoration Act. Doing KeyCite on 484 U.S. 872 will turn up a lot of "Superseded by Statute as Stated in" Keycites. Sounds like you might occasionally have to do searches based on the Key Numbers, since those searches will reference statutes too.

    Unfortunately, LexisNexis is not any better at this.

  • KeyCite? Why bother? I like to try to slip those types of things by... usually, nobody really notices. Sometimes they do though. Then I end up looking like a real dipshit.
